Access to and use of SolarisLight 'websites' (including any online courses, training material and tutorials) ('the Service') within Canada, US, UK and internationally is provided by SolarisLight Inc ('we', 'us' or 'our') on the following Terms and Conditions.

By using the Service you agree to be bound by these Terms and Conditions, which shall take effect immediately on your first use of the Service. If you do not agree to be bound by all of the following Terms and Conditions please do not access, use and/or contribute to the Service.

These terms and conditions are in addition to the Registrant Contract and Website Disclaimer/Terms and apply to the sale of any Online Course and/or Live Taught Course. Please read these terms and conditions carefully before purchasing an Online Course and/or Live Course and print off a copy for your records.

If there is any conflict between our Website Disclaimer/Terms, these terms and conditions and any Course Specific Terms and Conditions which might apply to a specific Online Course or Live Taught Course then the conflict shall be resolved by applying the following order of priority:

  1. Course Specific Registrant Contract Terms and Conditions;
  2. These Standard Terms-Conditions for Purchase of Online and Live Courses;
  3. Website Disclaimer/Terms.

For purchases via our website, by clicking on the "Accept" button you agree to the terms of this agreement which will bind you. If you do not agree to these terms and conditions you must cease to continue to purchase any Services from us.

SolarisLight will deny access to any online or live training to any individual who does not agree to the terms and conditions contained in the Registrant Contract and the Standard Terms & Conditions for Purchase of Online and Live Courses found at www.BioEnergyTHerapyTraining.com. Further, the SolarisLight reserves the right to terminate access to any individual who does not abide by these terms and conditions.

Registrants are deemed and presumed to be aware of and familiar with this eCourse Terms and Conditions Agreement. Any SolarisLight member, candidate or individual who is found to be violating or assisting or attempting to assist anyone in violating these Terms and Conditions is subject to investigation for Counseling and Discipline and/or any action the SolarisLight is authorized to take, including disciplinary action or termination.

Complaints regarding Participation, Terms and Conditions or complaints regarding a breach of these Participation Rules and/or this eCourse Terms and Conditions Agreement should be made in writing via eMail to Admin@SolarisLight.com.

0.1 Use of the Service

  1. You agree to use the Training Service only for lawful purposes. You may not use the Service or any part of it for commercial resale purposes.
  2. You must only use the Service in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of BioEnergyTHerapyTraining.com. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Training Service.
  3. We operate a 'fair use' policy to protect the quality of service to our users. If we believe you are using excessive bandwidth or your use of the Service is adversely affecting our network (or any part of it) or our other users we reserve the right to manage or regulate your usage of the Service. This may include temporarily suspending your user account.

0.2. Amendments

  1. SolarisLight reserves the right to make change to these Terms and Conditions from time to time and so you should check these Terms and Conditions regularly. Your continued use of the Service will be deemed acceptance of the updated or amended Terms and Conditions. If you do not agree to the changes, you should cease using the Service.
  2. If there is any conflict between these Terms and Conditions and specific local terms appearing elsewhere on the Service (including community rules) then the the above order of priority shall prevail.

0.3. Registration

  1. In order to participate in and contribute to SolarisLight courses and communities you may be required to register with SOlarisLight. Any personal information supplied to SolarisLight as part of this registration process and/or any other interaction with SolarisLight will be collected, stored and used in accordance with SolarisLight's Privacy Policy.
  2. To register on this website you must be over sixteen years of age unless you have the explicit written permission of your parent or guardian.
  3. You must ensure that the details provided by you on registration or at any time are correct and complete.
  4. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details with SolarisLight in order that we can communicate with you effectively.
  5. All user accounts must be registered with a valid personal email address that you access regularly so that moderation emails can be sent to you. Accounts registered with someone else's email address, or with temporary email addresses may be closed without notice. We may require users to re-validate their account if we believe they have been using an invalid email address.
  6. You must keep your password and user name confidential and not disclose them or share them with anyone. If you know or suspect that someone else knows your password you should notify us by contacting Admin@SolarisLight.com immediately.
  7. If SolarisLight has reason to believe that there is likely to be a breach of security or misuse of the websites, we may require you to change your password or we may suspend your account.
  8. SolarisLight reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts, overload or disrupt any of our services in any way.
  9. If you use multiple logins for the purpose of disrupting a community or annoying other users you may have action taken against all of your accounts.

0.4. Prices and Payment

  1. Your order or contract is an offer to purchase Online Course Services from us. The Online Course Service will be made available to you once your payment has been authorized and the course session has started. There will be no contract of any kind between you and SolarisLight unless and until you make authorized payment for the Online Course Service. At any point up until then, we may decline to supply the Online Course Service to you without giving any reason.
  2. The fee for the Online Course Service is calculated and payable in advance of the course start date as set out on the website. The Company shall be under no obligation to provide the Online Course Service until the fee has been paid.
  3. Payment may be arranged to clear prior to commencement of the course in a variety of ways: Wire Transfer, eTransfer, Money Order, Certified Cheque, Credit/debit via Telephone etc. No credit/debit card transaction details are stored by SolarisLight. Authority for payment must be given at the time of placing your order.
  4. Any automated credit/debit card transaction details are not handled by SolarisLight. All payment and all credit card handling is through the third party, PayPal Inc. We do not store any credit card details. Authority for payment must be given at the time of placing your order.

0.5. Availability of the Service

  1. Although we aim to offer you the best service possible, we make no promise that the services available from SolarisLight will meet your expectations. We cannot guarantee that the Service will be fault-free. If a fault occurs with the Service you should report it to admin@solarislight.com and we will attempt to correct the fault as soon as we reasonably can.
  2. Your access to the Service may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the Service as soon as we reasonably can.

0.6. SolarisLight's right to suspend or cancel your account registration

  1. We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
  2. You can cancel your registration at any time by informing us in writing at admin@solarislight.com. If you do so, you must stop using the Service.
  3. The suspension or cancellation of your registration and your right to use the Service shall not affect either party's statutory rights or liabilities.

0.7. Disclaimers and Limitation of Liability

  1. ALL CONTENT PROVIDED ON OR THROUGH THE SERVICE, INCLUDING THE INFORMATION, NAMES, IMAGES, PICTURES, LOGOS AND ICONS REGARDING OR RELATING TO SOLARISLIGHT, ITS PRODUCTS AND SERVICES (OR TO THIRD PARTY PRODUCTS AND SERVICES), IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS. TO THE EXTENT PERMITTED BY LAW, SOLARISLIGHT EXCLUDES ALL REPRESENTATIONS AND WARRANTIES (WHETHER EXPRESS OR IMPLIED BY LAW), INCLUDING THE IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, SECURITY AND ACCURACY. SOLARISLIGHT DOES NOT GUARANTEE THE TIMELINESS, COMPLETENESS OR PERFORMANCE OF ANY ASPECT OF THE SERVICE OR ANY OF ITS CONTENT. WHILE WE TRY TO ENSURE THAT ALL CONTENT PROVIDED BY SOLARISLIGHT IS CORRECT AT THE TIME OF PUBLICATION NO RESPONSIBILITY IS ACCEPTED BY OR ON BEHALF OF SOLARISLIGHT FOR ANY ERRORS, OMISSIONS OR INACCURATE CONTENT ON THE SERVICE.
  2. NOTHING IN THESE TERMS AND CONDITIONS LIMITS OR EXCLUDES SOLARISLIGHT'S LIABILITY FOR PERSONAL INJURY CAUSED BY ITS PROVEN NEGLIGENCE. SUBJECT TO THE PREVIOUS SENTENCE, NEITHER SOLARISLIGHT NOR ANY OF ITS OFFICERS OR EMPLOYEES SHALL BE LIABLE FOR ANY OF THE FOLLOWING LOSSES OR DAMAGES (WHETHER SUCH DAMAGE OR LOSSES WERE FORESEEN, FORESEEABLE, KNOWN OR OTHERWISE): (A) LOSS OF DATA; (B) LOSS OF REVENUE OR ANTICIPATED PROFITS; (C) LOSS OF BUSINESS; (D) LOSS OF OPPORTUNITY OR ANTICIPATED SAVINGS; (E) LOSS OF GOODWILL OR INJURY TO REPUTATION; (F) LOSSES SUFFERED BY THIRD PARTIES; OR (G) ANY INDIRECT, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING FROM THE USE OF THE SERVICE REGARDLESS OF THE FORM OF ACTION.
  3. SOLARISLIGHT DOES NOT WARRANT THAT FUNCTIONS AVAILABLE ON OR THROUGH THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR BUGS. YOU ACKNOWLEDGE THAT IT IS YOUR RESPONSIBILITY TO IMPLEMENT SUFFICIENT PROCEDURES AND VIRUS CHECKS (INCLUDING ANTI-VIRUS AND OTHER SECURITY CHECKS) TO SATISFY YOUR PARTICULAR REQUIREMENTS FOR THE ACCURACY OF DATA INPUT AND OUTPUT.

0.8. Applicable Law

  1. These Terms and Conditions will be subject to the laws of Canada. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the Canada.

0.9. International Use

  1. We make no promise that materials available on or through the Service are appropriate or available for use in locations outside the Canada , and accessing the Service from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Service from locations outside the Canada , you do so on your own initiative and are responsible for compliance with local laws.

0.10. Miscellaneous

  1. If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and Conditions and the remaining Terms and Conditions shall survive and continue to be binding and enforceable.
  2. You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
  3. If you breach these Terms and Conditions and SolarisLight chooses to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
  4. SolarisLight shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
  5. Your satisfaction is important to us, therefore, we take complaints seriously as an opportunity to grow a better future. SolarisLight is committed to developing and maintaining an effective, timely, fair and equitable grievance handling system which is easily accessible to all complainants. 0.11. Publicity

  1. The Online Service is owned and operated by SolarisLight Publishing Inc. a company registered in Canada and whose registered office is at Kitchener, Ontario, Canada N2P 2V9.

Online Course - Terms of Use

These terms relate to the paid-for on-line training services supplied to you through designated websites (the "Online Course Service(s)") and should be read in conjunction with our General Terms & Conditions above which shall also apply save where they are inconsistent with these terms.

1.0 Definitions

"Confidential Information" means information provided by one party to the other in written, graphic, recorded, machine readable or other form concerning the business, clients, suppliers, finances and other areas of the other party's business or products, including, without limitation, the Course Materials, but does not include information in the public domain other than through the default of the party disclosing the information, information required to be disclosed by any court or regulatory authority, or any information already in the possession or control of the disclosing party.

"Course Materials" means the information provided by SolarisLight to accompany a course provided as part of the Services in hard copy or electronic form.

"Fees" means the fees paid by you to SolarisLight Publishing Inc. for the Services.

"Intellectual Property Rights" means copyright, rights in or relating to databases, patent rights, performers' rights, designs and registered designs, trademarks, media, rights in or relating to Confidential Information and other intellectual property rights (registered or unregistered) throughout the world.

"Online Course or eCourse" means the delivery by us of an online course pursuant to which you learn course materials remotely.

"Services" means the provision of the Online Course and/or the Live Taught Course and/or the Course Materials together with such other services as agreed from time to time and purchased by you through the Website or by telephone.

"Live Course" means a course taught by us in a classroom setting to which you attend in person.

"Website" means the designated websites associated to SolarisLight in the delivery and contacting of onlive courses and support materials for the provision of continueing education.

"you" means the individual purchasing the Services.

2.0 The Services

2.1. A description of the Services together with the dates on which the Services will begin are available on our Website. We will provide the Services with reasonable care and skill in accordance with the description set out on the Website.

2.2. We reserve the right to vary or withdraw any of the Services described on the Website without notice.

2.3 We expect you to confirm that the Services you are purchasing will meet your needs. We do not make any guarantee to you that you will obtain a particular result, professional qualification or employment opportunity from your purchase and completion of any of the Services.

3.0 Ordering Services

Purchasing Services via the Website

3.1. In order to purchase any of the Services on-line you must register for an account with us via the Website. If you already have an account with us you can log into your account using your user name and password.

Purchasing Services via the Telephone

3.2. To purchase a Service over the telephone please call 950-456-8809. You do not need to have registered for an account with us to purchase any of the Services over the telephone. You must, however, register for an account with us to access your course on-line.

3.3. When you place an order for a Service via the Website, or telephone you are offering to purchase the Services on these terms and conditions. SolarisLight reserves the right to cancel or decline your order or any part of your order at any time until it has been confirmed in accordance with clause 3.5 below.

3.4. Following receipt by us of your order for Services via the Website or on the telephone we will contact you confirming receipt of your order.

3.5. A legally binding agreement between us and you shall come into existence when we have :
(a) received payment of the relevant Fees from you in accordance with clause 5 below.
(b) accepted your offer to purchase Services from us by sending you an email confirming the purchase; and
(c) upon your first access of the paid services.

3.6. Where your order consists of multiple Online Courses or multiple Live Courses, each individual course will be treated by us as a separate offer to purchase. Acceptance of your offer to buy one or more courses will not be acceptance by us of your offer to purchase any other courses which make up your order.

3.7. SolarisLight does not and is not responsible for booking any examination with any professional body or examination board. It is your responsibility to ensure that you book prior to the relevant closing date any exam necessary that you wish to take and which may or may not be associated with the subject matter of the Services provided to you by SolarisLight.

4.0 Cancellation and Variation

4.1. Scheduled courses require a minimum number of participants (6) to proceed. If the course is unable to proceed, SolarisLight offers registered participants an option to reschedule to a future course date OR request a full refund of any monies paid.

4.2. Subject to clause 4.4 below, where we have accepted / confirmed the Services being purchased by you and formed a legally binding agreement with you in accordance with clause 3.5 above, then you are permitted within 10 working days starting on the day after the date we have concluded our agreement in accordance with clause 3.4, to cancel your purchase of the Services.

4.3. Deposits for all training courses and workshops are non-refundable, except in extremely unusual circumstances (please contact SolarisLight to discuss unusual circumstances). SolarisLight reserves the right to transfer any individual's deposit for their attendance at a later course or workshop, at discretion of SolarisLight. When unusual circumstance occurs prior to course commencement of the course and a person must withdraw without even starting the course there may eligibility for up to 80% refund.

4.4. If you have purchased an Online Course and have already accessed, downloaded all or part of the Online Course and/or started to use that Online Course then you shall have no right to cancel your order.

4.5. Notwithstanding clause 4.3 there is no other right to cancel or vary your purchase of Services and any other cancellation and / or variation of course dates will be at the entire discretion of SolarisLight.

4.6. Attendance is the responsibility of student practitioners. SolarisLight eCourses are designed to be completed within a period of 12 months. Registrants have access to each eCourse one-year from the date of eCourse commencement.

4.7. Requests for transfer course registration to a later date is at the sole discretion of SolarisLight. Course credit will only be held valid for one year from the date of rescheduling regardless of whether the particular event/course is offered again within this time period. Due to the unreliability of email and voice mail, all rescheduling of programs must be in writing and delivered by postal mail, courier or by hand to SolarisLight. Verbal communication, Voice mail, and eMail does not constitute official cancelation. A rescheduling notice will be deemed active upon the date it is received in writing by SolarisLight.

4.8. Once a course has commenced, if a person decides to pull out of a course because they have simply decided that they don't want to continue, then there will be no refund of any monies paid. If an unforeseen circumstance prevents someone from continuing a course at the scheduled time, and they would like to continue at a future date, we are open to discussing this on a case-by-case basis, and will do what we feel is reasonable in regards to transferring money to another course, or refunding some of the monies paid, given the individual circumstances.

5.0 Fees

5.1. The Fees for the Services shall be as set out on the Website or as told to you over the telephone at the time you placed an order for them.

5.2. Unless otherwise specified at the time you purchase the Services the Fees are exclusive of HST, VAT or other local taxes, the cost of some Course Materials and any delivery costs payable in respect of the delivery of Course Material to you. Each of these costs will be set out in the Website or told to you over the telephone prior to your purchase the Services.

5.3. Save where specifically stated otherwise on the Website, all Fees shall be exclusive of any amounts payable to any professional body for registration and examination entry. These are payable by you directly to the relevant professional body or examination board and we accept no responsibility or liability for your failure to book your exam with the relevant professional body or examination.

5.4. Fees for the Service selected by you on the Website or purchased over the telephone shall be debited from your credit / debit card at the time of purchase. Fees must be paid in full prior to you attending any Live Taught Course or accessing any Online Course module.

5.5. Any fees charged by your debit or credit card provider in connection with your purchase of Services are for your own account and SolarisLight Publishing Inc. shall not be responsible for these.

5.6. You shall be responsible for all costs you incur in connection with your attendance at any Live Courses or your access onto any Online Course.

6.0 Liability

6.1. No part of the provision of the Services shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of investment or medical advice in contradiction to the conventional authorities governing such advice.

6.2. Although SolarisLight aims to provide the Services to the highest standards of the industry, neither it, nor its trainers accept any liability for (i) any inaccuracy or misleading information provided in the programmes or Course Materials and any reliance by Client on any such information, (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect, special or consequential loss arising from any breach of the terms of this Agreement.

6.3. Except to the extent that they are expressly set out in these terms and conditions, no conditions, warranties or other terms shall apply to the Services. Subject to clause 6.6 no implied conditions, warranties or other terms apply (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description).

6.4. Subject to clause 6.6 below, SolarisLight's total liability arising from or in connection with these terms and conditions and in relation to anything which we may have done or not done in connection with these terms and conditions and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the prorated module fees received by us in connection with the relevant Online Course or Live Course in relation to which a dispute has arisen.

6.5. The registrant understands that applying for a SolarisLight event/course they will be participating in an activity of instruction that may involve physical, mental, and emotional commotion and in such an undertaking there is always a possibility of personal distress. The registrant understands that in such a group event/course setting, the instructor cannot monitor the physical, mental, and emotional limits of attendees, therefore is fully cognizant of self-responsibly in assessing and choosing the level of active participation in each module. The registrant agrees to assume the risk and responsibility for any injury or damage arising from participation in the event/courses that are attended. In consideration of the opportunity to participate in SolarisLight event/course studies, the registrant hereby release, acquit, discharge, indemnify, defend, hold harmless, and waive all my rights to sue or be compensated by SolarisLight or any of the staff, training instructors, or students participating in the event/course in any way.

6.6. Nothing in this Agreement shall exclude or limit SolarisLight's liability for
(a) death or personal injury caused by negligence,
(b) fraudulent misrepresentation or
(c) any other matter which under Canadian law may not be limited or excluded.

6.7. No claim may be brought more than six months after the last date on which the Services concerned have finished or ceased to be provided by us.

7.0 Intellectual Property

7.1. All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on Service and all content (including all applications and materials) located on or available through the Service shall remain vested in SolarisLight.

7.2. You must not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to others or the public, or otherwise use SolarisLight website content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any SolarisLight content except for your own personal, non-commercial use. Any other use of SolarisLight content requires the prior written permission of SolarisLight.

7.3. The names, images and logos identifying SolarisLight and its brands or third parties and their products and services are subject to copyright, design rights and trade marks of SolarisLight and/or third parties. Nothing contained in these Terms and Conditions shall be construed as conferring any license or right to use any trade mark, design right or copyright of SolarisLight or any other third party.

7.4. All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by trainers at Live Courses are, and remain, the intellectual property of SolarisLight, whether adapted, written for or customized for the Client or not.

7.5. No Person or entity is authorized to:-

(a) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit, distribute or train any of the Course Materials without prior written permission;

(b) record on video or audio tape, relay by videophone or other means the Online Course or Live Taught Course given

(c) use the Course Materials in the provision of any other course or training whether given by us or any third party trainer;

(d) remove any copyright or other notice of SolarisLight on the Course Materials;

(e) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.

Breach by you of this clause 7.5 shall allow us to immediately terminate electronic access with you and cease to provide you with any Services, including but not limited to access to the Online Courses.

7.6. In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive licence to use specifc Course Materials and software in respect of the Online Course for the sole purpose of completing the Online Course and / or attending the Live Taught Course.

7.7. In consideration of your Graduation from certain courses, in respect of your Online Course achievement, SolarisLight will grant to you in writing a limited, non-transferable, non-exclusive licence to use specifcly provided SolarisLight materials, software, artwork and certain trademarks for the sole purpose of group association in public presentation and common practice of associated membership business subject to franchise policies and rules of use.

7.8. The term "course or eCourse" includes all web pages, course presentations, and all associated online and physical course materials. Therefore the registrant agrees to not use any robot, spider or other device, process or means to harvest SolarisLight eCourse material. Nor shall you use any process to monitor or copy our Web pages or the content contained therein or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not compromise or circumvent the security controls of the SolarisLight eCourses or otherwise gain unauthorized access to SolarisLight eCourses. You agree that you will not use any device, software or routine that interferes with the proper working of the eCourses nor shall you attempt to interfere with the proper working of the SolarisLight eCourses. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works or publicly display any content from the SolarisLight eCourses without the prior expressed written permission of the SolarisLight Institute.

8.0 Confidentiality

8.1. Each party shall keep the other party's Confidential Information strictly confidential and not use it otherwise than for the purposes of these terms and conditions, and shall return it on demand and not retain copies of it.

8.2. Either party may disclose Confidential Information to its legal and other advisors for the purposes of obtaining advice from them.

8.3. This clause shall continue notwithstanding termination of these terms and conditions.

9.0 Termination

9.1. We shall be entitled to terminate these terms and conditions and cease to provide you with any Services with immediate effect in the event that you:

  1. fail to pay when due your Fees;
  2. act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee of SolarisLight Publishing Inc, any teacher or lecturer who provides the Courses or any student who attends any Course;
  3. cheat or plagiarise any work which you are required to prepare or submit in connection with the Services or during any examination taken in connection with the Services;
  4. steal or act in fraudulent or deceitful manner towards us or our employees or any other students who may be on our premises or attending our Online Courses;
  5. intentionally or recklessly damage our property or the property of our employees or other students attending our premises;
  6. are intoxicated through alcohol or illegal drugs while on our premises;
  7. commit any criminal offence committed on our premises or where the victim is our employee or student;
  8. are in breach of these terms and conditions.

9.2. On termination clause 6 (liability), 7 (intellectual property rights), 8 (confidentiality) and 10 (restrictions) shall continue notwithstanding such termination.

10.0 Registrant Assignment

Any Services provided by us under these terms and conditions are personal to you and cannot be transferred or assigned to any other person.

We shall be entitled to assign these terms and conditions to any other company without prior notice to you.

11.0 Entire Agreement

These terms and conditions, together with the Website Disclaimer and Course Specific Terms and Conditions are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. You confirm that you have not relied on any representations in entering into these and any other terms and conditions with us. Nothing in this clause or terms and conditions shall limit liability for any fraudulent misrepresentation.

12.0 Force Majeure

SolarisLight shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport or technology disputes, failure to provide a course caused by a death in the trainer's family, illness of the trainer, Government edict or regulation.

13.0 Delivery Assignment

We may assign, transfer, sub-contract any of our rights or obligations to any third party at our discretion.

14.0 Data Privacy Protection

14.1 The nature of the Services provided by us means that we will obtain, use and disclose (together "Use") certain information about you ("Data"). This statement sets out the principles governing our Use of Data. By purchasing the Services you agree to this Use.

14.2 When you register with us you will need to provide certain Data such as your contact details and demographic information. We will store this Data and use it to contact you, provide you with details of the Services you have purchased and otherwise as required during the normal provision of the course.

14.3 We may also use the above Data, and similar Data you provide us in response to surveys, to aggregate user profiles and, unless you click on the relevant button on the Registration Form, provide you with communications. We will not pass any personal data onto anyone outside of SolarisLight.

14.3 To enable us to monitor and improve our Services, we gather certain aggregated information about you, including details of your operating system, browser version, domain name and IP address, the URL you came from and go to and the parts of the Website you visit.

14.4. We use information such as your User ID, session identifiers and password to enable us to identify whether you are using our services, assist with the provision of services and to ensure that you have access to relevant products. We will only read cookies from your cookie file placed there through your web browser's interaction with the Website.

14.5. Our products may link to third party websites and we are not responsible for their data policies or procedures or their content.

14.6. SolarisLight endeavours to take all reasonable steps to protect your personal Data including the use of encryption technology, but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of being and transacting on-line over the internet and will not hold us responsible for any breach of security.

14.7. SolarisLight may supplement the information that you provide with information we receive from third parties, such as exam registration bodies or your employer.

15.0 Law and Jurisdiction

This Agreement is subject to Canadian law and the parties submit to the exclusive jurisdiction of the Canadian courts in connection with any dispute hereunder.

I INDICATE MY ACCEPTANCE OF THE FOREGOING TERMS SIMPLY BY ENTERING OR CONTINUEING TO READ, VIEW, OR LISTEN TO MATERIAL PRESENTED BY THIS SITE. IN THE EVENT OF MY DECLINING ACCEPTANCE OF THE FOREGOING TERMS, I AGREE TO IMMEDIATLY DISCONTINUE UTILIZING THIS SITE.
